Abstract

In recent years, the usage of social media has grown drastically with platforms such as Facebook, WhatsApp, and Twitter. It has experienced significant growth and transformation over the years, becoming an integral part of the country’s digital landscape. It has become a significant part of modern communication, providing networking opportunities. The managing of the massive volumes of social media networks is one of the most difficult issues in this generation. This rapid growth of social media platforms has put forth innumerable legal challenges in India prompting the government to consider regulations to address various concerns. Social media must balance this right with the need to combat legal challenges. Addressing these legal challenges while respecting fundamental rights is essential for creating a balanced regulatory framework for social media in India. The dynamic nature of social media demands the necessity for an adaptable legal framework. This article explores the existing laws, it’s inadequacy and the legal hurdles in regulating social media laws within the Indian context. It brings out issues such as defining the scope of regulation and balancing fundamental rights.
